Notes for WILLIS SWINDELL:

Pvt. Willis Swindell served in theRevolutionary War at a very young age. He was said to have been a spy for theContinental Army. He was accepted for the DAR as a supplement, p. 205:"Swindle (Swindell) Willis b 3-5-1763 d 5-9-1851 m x Pvt NC."According to Syble Sayre, he was appointed patroller in Captain Thomas Daniels'district in 1800 or 1808.205 He was a member of the Mattamuskeet PrimitiveChurch in 1808. He would have been married at this time to Ashley's mother(Willis' second wife). Also on this church's roster was a couple with the lastname of Ashley. Quite possibly these two were Ashley's grandparents (this isstill speculation).206 He moved from Randolph Co., North Carolina to Henry Co.,Indiana. He appears in both county's census records for the same year.

Wife: Sally SWINDELL during her naturallife to have a piece of land containing the building and all the profits arisingtherefrom bound as follows: Beginning at a ditch near the gate and dwellinghouse and running with the ditch eastwardly by the graveyard to the line ofMarcus SWINDELL, then with his line and Daniel SHAW's line to his WATSON tract.She is also to have my Negros Levine, Rose and Little Nance, all the household& kitchen furniture excepting one bed and furniture, her choice of horse andgig, 3 cows & calves, 1000 cypress rails in the Popler Ridge Swamp, and acompetancy for her one year's provision.

Son: Dixon SWINDELL 8 acres on theeasternmost bounds. Also the land and plantation whereon I now live exceptingonly the life estate of my beloved wife. Also all my right, title & interestof an undivided tract of land in John SWINDELL's 300 acre patent on the ___thside of Mattamuskeet Lake. Also Negroes Caswell & Anson.

Also 1/2of the tract of land joining Daniel SHAW and Marcus SWINDELL on the ___th whichI bought of Cason JONES & wife and Cason GIBBS joining the BRADLY tract,excepting a privilege of firewood for my wife.

Son: William SWINDELL two Negroes Grace& Ben; one bed and furniture and $50 to be paid out of the sales of otherproperty.

Son: Joseph SWINDELL two Negroes Kelly& Eliza.

Dau: Matilda SELBY during her naturallife the tract of land I bought of Robert JENNETT and the land I bought at theSheriff's sale, both of which is known as the M_____ tract joining Noah GIBBSand others. After Matilda's death then the tracts of land to her lawful childrenthat may be living at the time of her death to be equally divided. Also Matildais to have Negroes Sam & Simeon and the balance of cypress rails in thePopler Ridge Swamp.

I will that my executors sell either atprivate or public sale the following Negroes: Martin, Old Nance, Slade, Codel?and Ann; also the stock, crop and all other things not willed or given away forthe purpose of paying my just debts. I Annmarah Swindell of the county ofHyde and State of North Carolina being of sound mind and memory but consideringthe uncertainty of my earthly existence, do make and declare this my last willand testament in manner and form following, that is to say:

First - That my executor (herein afternamed) shall provide for my body a decent burial, suitable to the wishes of myrelations and friends and pay all funeral expenses, together with my just debts,howsoever and to whomsoever owing, our of the moneys that may first come intohis hands as a part or parcel of my estate.

Item: I give and devise to myeldest-son Cason E. Swindell twenty five acres of land adjoining SamuelSpencers land, to have and to hold to him his heirs in fee simple forever.

Item: I give and devise to my sonThomas M. Swindell twenty five acres of land on the south side of the roadrunning to the Lake and in the East corner of the farm adjoining Seth GibbsJoseph Young heirs and Daniel Neal it being that part where on he now lives tohave and to hold to him his heirs in fee simple forever.

Item: I give and devise to my daughterEmeline W. Swindell the remainder of my land together with the buildings where Inow live to be twenty five acres more or less. My will further is that mydaughter Emeline W. Swindell at my death shall have all of my personal property,the said land she is have and to hold to her heirs in fee simple forever.

Item I give my three children an equalprivilege to the timber for the purpose of building and fencing until the landwhere on the said timber grows is cleared, also an equal privilege in the ditchand road running to the lake.

And lastly I so hereby constitute andappoint by trusty friend, Cason E. Swindell, my lawful executor to all intentsand purposes, to execute this my last will and testament according to the trueintent and mearning of the same and every parr and clause there of herebyrevoking and declaring utterly void all other wills and testaments by meheretofore made.
